New Delhi: A Delhi court on Friday refused to order the police to disclose the CCTV footage of the site where the recent BMW accident occurred. The court stated that the accused will be provided with all evidence against her once the chargesheet is filed. Judicial magistrate first class Ankit Garg said that the prosecuting agency cannot be compelled to reveal the authenticity or contents of the evidence collected by investigators at the behest of the accused. However, he directed police to inform the court whether the CCTV footage includes visuals from metro pillar numbers 65 and 67 at Dhaula Kuan. Advocates Pradeep Rana and Gagan Bhatnagar, representing the accused Gaganpreet Makkad, argued that police had not clarified whether the preserved footage captures the incident itself or merely the place of occurrence. Objecting to the arguments, additional public prosecutor Dishank Dhawan said Makkad’s application was not maintainable at this stage. The judge, however, noted that the application was for the preservation of footage, not to interfere with the investigation. He observed that the accused sought confirmation from the prosecuting agency that the accident appears in the footage. The matter will be heard again on Saturday, alongside Makkad’s bail plea. The court confirmed that orders for preserving the CCTV footage have already been issued. Navjot Singh (52), a finance ministry official and resident of Hari Nagar, was killed in the accident on Ring Road near the Delhi Cantonment metro station.
