New Delhi: A Delhi court recently dismissed an application by a murder accused seeking transfer of his case to another court. The court observed that his claims of bias and unfair treatment were based solely on “unsupported allegations” without any concrete evidence or documentation to substantiate the contention.The court of Madhu Jain, principal district and sessions judge, west, Tis Hazari courts, in a June 5 order, stated that the record shows the trial is being conducted according to legal procedures and does not indicate any undue bias or procedural irregularity by the court.“The facts and circumstances show that the applicant’s allegations are merely an attempt to delay the proceedings before the trial court. There is no evidence on record to support the claims of the applicant that the learned trial court is conducting the trial in a biased manner or not adhering to legal procedures. Therefore, the allegations lack sufficient proof and the transfer petition seems to be aimed more at stalling the trial rather than addressing any actual judicial unfairness,” the judge said.According to the prosecution, the chargesheet in the present case is yet to be filed and while the accused is in judicial custody, two other accused are yet to be arrested in the matter.The judge noted that the non-disclosure of time, dates, specific instances and the nature of the transfer application indicate that it has been intentionally filed not to address genuine concerns but to create procedural obstacles and delay the trial.
